Digital acceptance and electronic signatures

Legal recognition

Under the federal Electronic Signatures in Global and National Commerce Act (E-SIGN) and the Uniform Electronic Transactions Act (UETA) as adopted in the applicable state, an electronic signature and an electronic record have the same legal effect as a handwritten signature and a paper record. A contract may not be denied effect solely because it was formed electronically.

What counts as your signature

Any of the following, where the context shows you intended to sign:

• Typing your name into a signature field.
• Drawing or uploading a signature image.
• Clicking a clearly labeled button that says you accept or agree.
• Replying to confirm assent where the document says a reply constitutes acceptance.

Your consent

By signing or accepting electronically, you confirm that:

• You consent to transact business electronically and to receive records electronically.
• You are able to access, read, and retain the document in the format provided.
• You intend your electronic signature to bind you to the document's terms.
• You are authorized to sign on behalf of the entity you are signing for, if any.

Records and retention

We retain a copy of each executed document together with the audit information our signature provider records, which typically includes the signer's name and email, timestamps, and the IP address used. You may request a copy of any document you signed with us at any time.

Withdrawing consent, and paper copies

You may decline to sign electronically or withdraw your consent to electronic records at any time by writing to info@yellowhammerenterprises.com. We will provide a paper alternative. Withdrawing consent does not affect the validity of anything already signed.

What you need to sign electronically

• A current web browser with cookies and JavaScript enabled.
• A working email address that you can access.
• The ability to view and save PDF files.
• A device capable of printing or storing a copy for your records.
